Scope and contracting party
These Terms and Conditions apply to contracts between Rücker Computersysteme | Rückergruppe, proprietor Magnus Rücker (“Contractor”), and its customers for IT support, diagnostics, repairs, backup and remote support, networks and servers, custom software, databases, interfaces, automation and inventory-management systems, web design and online shops, satellite-internet consultation and installation, and related services. Individual agreements and the relevant quotation take precedence.
Enquiries and conclusion of contract
Contact-form messages are non-binding enquiries. A contract is concluded by acceptance of a quotation, written or electronic order confirmation, or commencement of work at the customer’s express request. Scope, objectives, remuneration, deadlines and deliverables are defined in the quotation or order. Additional requests are agreed and charged separately.
Customer cooperation and backups
The customer must provide the required information, access, equipment, content, rights and approvals in good time. Before IT, installation, repair or remote-support work, the customer must create a current and verified backup wherever reasonably possible. Delays and additional work caused by incomplete or incorrect cooperation may be charged separately.
Diagnostics, repairs and remote support
Diagnostics reflect the condition identifiable during inspection. A particular repair or data-recovery result is owed only if expressly agreed. Remote support requires prior agreement and active approval by the customer, who may end the session at any time and should change any credentials disclosed for the work.
Software and AI-assisted development
Functions, platforms, interfaces, migration, roles, documentation, source-code delivery, tests and project stages are governed by the quotation. Changes outside the agreed scope and adaptations to changed third-party systems are additional services. AI-assisted tools may support development, while professional review and testing remain required. Confidential or personal customer data is not sent to external AI services without the necessary agreement and lawful basis.
Websites, hosting and third-party services
The quotation defines the scope, design, functions, deliverables and revision rounds for web projects. Domains, hosting, licences, satellite tariffs and other third-party services are generally contracted directly between the customer and the provider. Their availability, prices and terms are outside the Contractor’s control unless otherwise agreed.
Ongoing support and security
Continuous monitoring, maintenance, backups, updates or security support is owed only where expressly agreed. After handover, the customer remains responsible for necessary updates, backups and security notices or for commissioning further support.
Customer content and rights of use
The customer warrants that supplied texts, images, data and instructions may lawfully be used. Following full payment, the customer receives the rights of use specified in the quotation. Rights in pre-existing tools, templates, general know-how and open-source or third-party components remain with their respective owners.
Prices, deadlines and acceptance
The agreed prices apply. Estimates are binding only if expressly designated as such. Deadlines are binding only where expressly agreed and are extended appropriately where customer cooperation is late or circumstances outside the Contractor’s control cause delay. Where acceptance is required, statutory rules apply.
Defects and liability
Statutory defect rights apply. The Contractor has unlimited liability for intent, gross negligence, injury to life, body or health, product liability and assumed guarantees. For slightly negligent breach of an essential contractual obligation, liability is limited to foreseeable damage typical for the contract. Recoverable data-restoration costs are limited to the effort required with a proper current backup, unless the Contractor was responsible for the backup.
Consumers and withdrawal
Consumers may have a statutory right of withdrawal for distance or off-premises contracts. Where required, separate cancellation information and a model form are provided. If work is to begin during the withdrawal period, the legally required express declaration will be obtained. The Contractor does not participate in consumer arbitration proceedings.
Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection at the consumer’s habitual residence remains unaffected.
